On February 14, 2019, the Supreme Court of British Columbia (the “Court”) granted an order (the “Receivership Order”) appointing Alvarez & Marsal Canada Inc. as receiver (the “Receiver”) without security, of all or any of the assets, undertakings and property in Canada of Masahiko Nishiyama (the “Debtor”).

Subsequently, on July 19, 2019, the Court granted an order, which provides for, among other things (the “July 19, 2019 Order”):

1. the assets and property of Sun Moon Management Ltd. represent Property, as defined in the Receivership Order, of the Debtor, including a condominium unit located at #4102 – 1028 Barclay Street, Vancouver, British Columbia (the “Condo”);
2. a Mercedes S550 vehicle, VIN WDDNG8GB0AA343089, registered to Hatsumi Nakajima (the “Mercedes”) is the Property of the Debtor; and
3. the Receiver shall conduct a claims process for personal property located in the Condo or the Mercedes (the “Personal Belongings”). Further details regarding the claims process of the Personal Belongings can be found here.
